2. Your registration obligations

By using the website and the services, you represent and warrant that you are of legal age to form a binding contract under the laws of the United States or other applicable jurisdiction. By using Big Data SmartSurveyApp’ website and services, you agree to the followings

  • You only publish accurate survey materials and/or data projects for which you would like to collect information
  • Data/documents must be relevant to survey or project description.
  • You must not manipulate your data and/or any relevant documents once you submit them on the platform.
  • Do not upload documents or digital materials that contain profanity, violent messages, abusive language, insanity and threats.
  • Only upload data and/or digital materials with your original content that does not violate these guidelines.
  • Materials must not contain any advertising contents.
  • Do not post viruses, infected files and/or malicious files.
  • Big Data SmartSurveyApp reserves the right to remove or delete any material that does not abide by these guidelines. In addition, violating any point contained in these guidelines may result in terminating user’s account.
  • Big Data SmartSurveyApp takes no responsibility for the content of any data or information posted by users on this website.
  • Make our website clean and safe.
  • In our sole discretion, we reserve the right to delete any data and/or digital materials, which we reasonably believe, is unlawful, inappropriate, does not abide by this agreement and/or could result in any liability to Big Data SmartSurveyApp.

4. Using Big Data SmartSurveyApp’ Platform

While using Big Data SmartSurveyApp, its services and online applications, you agree not to:

  • Post inappropriate, violent texts and/or threats.
  • Violate any laws, regulations, third party rights (e.g. third party’s intellectual property rights;) or our policies.
  • Manipulate data, coupon values and expiration dates.
  • Manipulate Big Data SmartSurveyApp’ billing setting.
  • Manipulate your username.
  • Fail to submit payment for requested services.
  • Use stolen and/or forged credit card to make payment.
  • Post inaccurate, false, misleading, defamatory, malicious content.
  • Distribute spams.
  • Distribute viruses or any other technologies that may harm Big Data SmartSurveyApp and/or its users.
  • Transfer your Big Data SmartSurveyApp’ account (including your User ID, Password and/or payment data) to another party without Big Data SmartSurveyApp’ approval.
  • Collect other Big Data SmartSurveyApp’ users information for personal and/or commercial use, without their consent and Big Data SmartSurveyApp’ approval.
  • Share your account information with third party.
  • Commercialize any Big Data SmartSurveyApp’ features/applications and/or tools
  • Reproduce, modify, or distribute rights or content from Big Data SmartSurveyApp’ website features or tools and Big Data SmartSurveyApp 's copyrights.
  • File a lawsuit against Big Data SmartSurveyApp’ regardless of the nature of issues/conflicts that may arise between you and Big Data SmartSurveyApp.

5. Disputes

Any disputes open by a user (client or survey particpants) against Big Data SmartSurveyApp must be resolved between the user and Big Data SmartSurveyApp. Users cannot file a lawsuit in a court against Big Data SmartSurveyApp regardless of the nature of disputes/conflicts that may arise between them and Big Data SmartSurveyApp.

6. Security

All transactions through Big Data SmartSurveyApp are carried out in a Secure Socket Layer (SSL) session, hence, safe and secure. Your credit/debit card and personal data are safe and are never stored in our databases or servers. Our Secure Sockets Layer software is the industry standard and among the best software available today for secure online transactions.   • Interfere with or disrupt the Big Data SmartSurveyApp’s services or servers or networks connected to the Big Data SmartSurveyApp, or disobey any requirements, procedures, policies or regulations of networks connected to Big Data SmartSurveyApp, including using any device, software or routine to bypass our robot exclusion headers;
  • Provide material support or resources (or to conceal or disguise the nature, location, source, or ownership of material support or resources) to any organization(s) designated by the United States government as a foreign terrorist organization pursuant to section 219 of the Immigration and Nationality Act;
  • "Stalk" or otherwise harass another; and/or
  • Collect or store personal data about other users in connection with the prohibited conduct and activities set forth in paragraphs a through m above.

You acknowledge that Big Data SmartSurveyApp reserves the right to terminate your account, remove comments and/or materials that do not abide by the above guidelines or that appear to be spam.

10. User account, password and security

Upon completing the Big Data SmartSurveyApp’s Services registration form, it is solely your responsibility for maintaining the confidentiality of the password and account, and you are fully responsible for all activities that occur under your account. You agree to (a) immediately notify Big Data SmartSurveyApp of any unauthorized use of your account or any other breach of security, and (b) ensure that you exit from your account at the end of each session. Big Data SmartSurveyApp cannot and will not be liable for any loss or damage arising from your failure to comply with this part of the agreement.

11. Disclaimer

The Service content from or through the Service is provided on an “As-Is” basis. We do not warrant that this service will be uninterrupted or error-free. There may be delays, omissions, and interruptions in the availability of the service. Where permitted by law, you acknowledge that the service is provided without any warranties of any kind whatsoever either express or implied, including but not limited to the implied warranties of merchantability and fitness for a particular purpose. You acknowledge that use of the service is at your own risk. We do not represent or endorse the accuracy or reliability of any person's advice, opinion, statement or other information displayed, uploaded or distributed through the services by Big Data SmartSurveyApp, our partners or any user of the service or any other person or entity. You acknowledge that any reliance upon any such opinion, advice, statement or information shall be at your sole risk. The sole and entire maximum liability of Company for any reason and user’s sole and exclusive remedy for any cause by the user shall be limited to the amount paid by the customer for the particular goods or services purchased. Company and any of its affiliates, dealers or suppliers are not liable for any indirect, special, incidental or consequential damages (or damages from loss of business, loss of profits, litigation, or the like), or losses based on breach of contract, breach of warranty, tort (including negligence, product liability or otherwise, even if advised of the possibility of such damages). The limitations of damages set forth above are fundamental elements and the basis of the bargain between Company and user. 12. Payments

Clients represent and warrant that (i) if any credit card payment is involved, all credit card information supplied is true, correct and complete and (ii) payments incurred by clients will be honored by clients’ credit card company. Users agree to keep their account login credential confidential and immediately notify Big Data SmartSurveyApp of any breach of this contract or unauthorized use of password, as Big Data SmartSurveyApp does not protect users from unauthorized use of their password-protected account.

13. Editing, Deleting and Modification

Big Data SmartSurveyApp reserves the right in its sole discretion to edit or delete any information or content appearing on the website and to remove any services for sale. Upon notice published over the service, Big Data SmartSurveyApp may modify this Contract, discontinue or revise any or all aspects of the site in its sole discretion and without prior notice. Cancellation of this Contract will be deemed effective upon publication on the website with respect to transactions showing after said date.

14. Right to refuse

Big Data SmartSurveyApp reserves the right in its sole discretion to refuse service at any time. Services are subject to availability.

15. Indemnification

User agrees to indemnify Big Data SmartSurveyApp, employees, agents, affiliates, licensors and suppliers harmless from any liability, loss, claim, including reasonable attorney’s fees which Big Data SmartSurveyApp may suffer from user’s activities on or use of the service, including without limitation any breach by user of this Agreement or any charges or complaints made by other parties against the user related to user’s violation of this Contract or use of services. User shall cooperate as fully as reasonably required in the defense of any claim. Big Data SmartSurveyApp reserves the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you; provided; however, that you shall remain liable for any such claim.

16. Acknowledgement

This agreement represents complete understanding between you and us regarding your relationship to online and supersedes any prior warranties or representations.
